The purpose of this consultancy is to support efforts to increase and improve in quality publicly available information available regarding criminal accountability for war crimes and other transitional justice (TJ) mechanisms in the targeted countries of the Western Balkans - Croatia, Bosnia and Herzegovina (BiH), Serbia, and Montenegro. This will be achieved by, i.a., creating a public information portal with regionally aggregated non-confidential data and analyses on war crimes and on-going transitional justice processes.

The main objective of the consultancy is to undertake a scoping study to identify availability of and gaps in regionally aggregated public data collection on war crimes trials and other transitional justice processes and to undertake a needs assessment in order to propose an optimal model of a regional information portal, as well as other related public information and outreach activities that would make data more available to the media, victims and the public at large.

Background Information
The consultancy is planned within the Regional War Crimes (RWC) Project (BiH, Croatia, Serbia and Montenegro), implemented by the UNDP.
The RWC Project aims to strengthen the rule of law in the Western Balkans (namely in Bosnia and Herzegovina, Croatia, Montenegro, and Serbia) by contributing to the effective fight against impunity for war crimes through support to regional cooperation in war crimes processing and other efforts to address the legacy of the conflict from the nineties in region. The project builds on the Platform for Regional Cooperation on processing war crimes and the search for missing persons, established among the POs and IMPs of BiH, Croatia, Montenegro and Serbia, which has been facilitated by UNDP since 2015, under the initiation phase of the project. The platform has supported trust-building among the key actors, re-activation of cross-border communication, exchange of information and evidence, as well as commitment to joint investigations.

The overall aim of the RWC Project will be realized through the achievement of the following project outputs:

Strengthened regional cooperation among prosecution services through improvement of the legal framework for cross-border cooperation aimed at increased efficiency of the war crimes processing in BiH, Croatia, Montenegro, Serbia;
Establishment of cross-border victim and witness support system and framework of regional consultations between the victims’ associations and Prosecutors Offices, including enhanced communication with victims and the public.
Overall, the project will contribute to maximizing societal impact of criminal proceedings and other transitional justice processes contributing to a conducive environment for reconciliation and sustaining peace in the region. It will do so through expediting the prosecution of war crimes, enhancing cross-border support to victims and witnesses, facilitating regional dialogue among POs and other relevant institutions, including IMPs, and victims’ associations, while also promoting transparent and data-based communication and public outreach on processing of war crimes cases, search for missing persons and other transitional justice processes.

Duties and Responsibilities

The needs assessment and scoping study by the consultant will establish and analyse the current, challenges and obstacles for more intensive and wider distribution of accurate non-confidential information on war crimes proceedings and other TJ processes to the public in the Western Balkans region- specifically - Croatia, Bosnia and Herzegovina (BiH), Serbia, and Montenegro. It will explore and propose how public information and outreach can be improved through a public information portal, as well as other potential activities, and explore and assess feasibility of new forms of communication and public outreach at regional level. The assessment and scoping study should also offer recommendations concerning technologies for and approaches by judicial and other state institutions in public communication as well as communication with specific target groups (such as victim communities and youth), taking into account specific needs and level of capacities and developments in each of the four countries.

The portal to be developed should offer open data, analyses, visualizations, (in line with data protection regulations) and be linked outward from the POs’ and other institutions’ data sources and should aim to serve as a one-stop access point to data, contextual information, and resources for the media, civil society, victims’ associations, educational institutions, experts, and the general public. As such, it will also link together main project stakeholders and the public. The assessment/scoping study should propose and outline;

The types of content for the portal;
Modalities for uploading/updating the portal with information;
Review other portals/data access points to ensure complementarity and avoid duplication;
To link to and tap into the various information sources that currently exist, including in the civil society and media sector;
Recommendations on how to connect the portal to the official websites of the prosecutors’ offices and other relevant institutions, such as courts, missing persons institutions, or various institutes.
A communication and outreach strategy for promoting the portal and proactively disseminating information it offers, especially to certain stakeholders or target groups, such as the media, but also universities in the region, victims association, youth organisation, etc. should also be addressed by the study.

The consultant should also provide an assessment of IT and other technical capacities that should be made available for such a portal to exist and function, as well as propose options for its long-term sustainability. The consultant will take into account activities and plans of other development stakeholders engaged in similar transitional justice related activities in the region.

The needs assessment/scoping study will be conducted through consultant’s direct communication with the representatives of the relevant national institutions (POs, courts, missing persons institutions), media, CSOs, victims’ community, international stakeholders and other relevant collocutors. Such communication should be carried out by combining direct meetings with remote communication (skype, e-mail, phone). In addition, the consultant will do a content analysis of the existing media platforms and tools (institutions and CSOs websites, media portals, etc.) that offer information and materials on the matter and examine available and relevant reports and literature on the matter.

The Consultant will present the study to the UNDP in the form of a report which will also outline specific recommendations for UNDP’s and other possible interventions and support in this area.

More specifically, Consultant will undertake the following main tasks:

Task 1: Design and planning of a needs assessment/scoping study
Under this task the Consultant will:

Familiarize himself/herself with key stakeholders, documents and challenges have a meeting with the RWC Project team;
Based on the inputs from the RWC project team, provide a methodology for conducting a needs assessment and scoping study, given the scope of work, and the purpose and objective of the consultancy, as explained above; outline a plan of meetings and external contacts for the purpose of the study; submit the methodology and plan to the RWC Project Team for approval. The level of effort for this task will not exceed 2 expert days.
Task 2: Collecting information for the study
Under this task the Consultant will:

Based on the approved methodology and plan, collect information for the needs assessment study on the issues described above, in particular through:
o liaising with and interviewing representatives of the POs, courts and other competent national institutions in the region (such as institutions for the search for missing persons), media, CSOs, including victims’ associations and other relevant national and international stakeholders;
o reviewing the current media reporting on the subject (by reading media portals, watching electronic media contributions and reading the press, reviewing institutions’ and CSOs websites and portals);
o reviewing reports on public information and outreach and other available sources and literature on the matter;
o collecting relevant information through other sources as appropriate.
The level of effort for this task will not exceed 12 expert days.

Task 3: Producing a needs assessment report
Under this task the Consultant will:

Analyse the collected information and prepare a report, including detailed findings on identified needs and tailor-made recommendations, with a focus on public information portal, as explained above under the “Scope of Work”.The level of effort for this task will not exceed 11 expert days.

Academic Qualifications/Education

Master`s degree in humanities, social sciences, communications, journalism, development or other relevant social sciences. Bachelor’s degree with additional two years of working experience may be accepted in lieu of the master’s degree.

At least 8 years of professional experience in the areas of public information, journalism or media relations, and transitional justice in public institutions (national or international), media, civil society organisation or development organizations.
Professional experience with public and media relations, public information, and public outreach of national or international institutions or civil society organisations dealing with criminal accountability and other transitional justice processes, preferably in relation to the Western Balkans; such experience in relation to other conflict or post-conflict geographical areas will be considered an asset.
Previous professional experience as a journalist covering the Western Balkans, especially topics of national and regional politics, justice, or reconciliation, will be considered a strong asset.
Experience with and excellent knowledge of functioning of various media platforms, including social media.
Excellent knowledge of the media landscape in the Western Balkans, especially the media coverage of war crimes trials and other transitional justice processes.
Knowledge of transitional justice processes in the Western Balkans, its key stakeholders and main challenges, including familiarity with the institutional landscape in the areas of war crimes case and other transitional justice processes.
Proven analytical skills and ability to synthetize information, conceptualise and write concisely and clearly.
Languages Requirements

Fluency in Bosnian-Croatian-Montenegrin-Serbian (BCMS) and English.

Financial proposal in USD which will separately specify professional fee, indicating number of anticipated working days, travel costs (air-ticket or use of private vehicle), living allowance, and all other applicable costs.

Financial Proposal

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diem, and number of anticipated working days).

All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general, UNDP does not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources.

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
