Bosnia and Herzegovina is facing an intricate set of development challenges, including economic decline, high unemployment, growing poverty and socio-economic inequalities. The complex administrative structure has led to political deadlocks, while slow legislative processes further hamper development. There is limited progress in finding political compromise on necessary reforms, including those required for integration to the European Union (EU). Many constraints persist on the economy, including poor infrastructure and a generally unattractive investment climate.

Placed within such a complex environment, local governments (LGs) have monotype competences, despite considerable differences in their size. LGs design integrated strategies, where social, economic, and environmental sectors are inter-connected to produce sustainable results. Nearly 30% of LGs have begun to apply an integrated municipal management approach. Yet, deficiencies in decision-making, internal management and organisation, policy and regulatory frameworks, as well as inadequate operational capacity hamper effective policy delivery.

Both finances and priority wise, water and environmental sanitation services are the most important LG services. More than 40 % of the country population of 3.8 million lacks access to safe water, with less than 40 % connected to the public sewerage system. Water losses frequently amount to more than 50 %, leading to overexploitation of water sources and high distribution costs. Water tariff levels are often too low to cover operation and maintenance, let alone enable capital investments. Further support to LGs and water utilities in cooperation with sectoral ministries at entity and cantonal levels is needed to increase service delivery management capacity and accountability through regulatory frameworks, ensuring functional and fiscal compliance across jurisdictions. Increasingly frequent floods and droughts adversely affect local service delivery, pointing to the lack of disaster risk reduction (DRR) policies and measures.

Because LGs are the intersection through which most business creation flows, their role is instrumental in creating a business-conducive environment and stimulating economic growth. Despite positive experiences, including pilot certification of “business-friendly” certification, LGs in Bosnia and Herzegovina still lack sound economic expertise and tools to engage in productive public-private dialogue and increase investment attractiveness of their localities through viable business infrastructure, support to employability and local entrepreneurship.

In order to address these challenges, the Municipal Environmental and Economic Governance (MEG) Project has been launched, supported by the Government of Switzerland and implemented by UNDP. The Project will support democratic local governance and improve quality of public services, focusing on the economic and environmental sectors. Together with its 18 partner local governments, private sector counterparts, relevant cantonal, entity and state level institutions, the Project will enhance municipal performance, applying sound public policy and management processes, spurring interaction among local decision-makers and citizens, and supporting capital investment to unlock sustainable economic growth and job creation. Importantly, the Project will support improvement of regulatory frameworks, with specific focus on the economic and environmental sectors and relevant public services. At times it is, though, not only the state of the regulatory framework that impedes effective local public service delivery, but rather the policy delivery capacities at the higher government level. Therefore, the Project will support selected cantonal and entity ministries in improving their policy design and delivery capacity. As relevant, the Project will utilise and contribute to on-going policy and regulatory reforms in the economic and environmental sectors, instigated by eventual advancement of the country on the EU accession path and entering in negotiations on the EU acquis communautaire in these sectors. The Project will further support and collaborate with the existing professional networks, since they have proven to be instrumental in improving LG good governance practices in general and public service delivery in particular. The expected overall Project duration is 12 years, while the first phase will last four years focusing on the area of Una-Sana Canton and Prijedor, as well as the wider Doboj-Tuzla region.

Duties and Responsibilities
Under the direct supervision of the Project Manager, the Legal and Institutional Capacity Development Officer will have the following key functions:

Steer the process of participatory design of relevant amendments / designing of new regulatory framework in the environmental and economic sectors, towards better local service delivery:

Assists with the design and conduct of regulatory gap assessment, with focus on the economic and environment sectors;
In direct interaction with institutional partners and the Project relevant staff, pro-actively leads and supports the participatory amendments of existing local governance-related principal or sectoral regulatory framework , with considerations for adjustment of apportionment of responsibilities across government levels, as well as for introducing fiscal/functional decentralization features within the respective sector-related regulatory framework;
Provides guidance and legal advice to relevant higher government level institutions (entity, cantonal) in drafting new or revising existing regulations, abreast with the main EU requirements;
Organises and supports participatory discussions and information campaigns on draft regulatory acts among the structures of the Associations of Municipalities and Cities, thematic professional organisations, as well as with the private sector (where relevant);
Supports the Project or the Associations of Municipalities and Cities to develop Guidelines for LGs on how to implement the new regulatory acts, thus facilitating their follow-up application and implementation by LGs;
In direct interaction with the Local Government and the Economic Development Officers, offers on-demand support to partner LGs in developing model policies on investment promotion, preparing guidebooks and instructions about permitting / licensing procedures that integrate disaster risk reduction, enforcement of already existing regulations which implementation is ineffective;
Ensures compliance of the good governance performance benchmarks to be introduced by the Project with the relevant regulatory framework;
Compiles and prepares manuals, publications, guidelines and best practices in the area of regulatory frameworks and processes throughout the Project implementation;
Provides advice and legal inputs to LGs to advance municipal regulations, procedures and rulebooks;
Supports the Project’s efforts to strengthen the legislative capacity of Municipal Councils and their interaction with the mayors/administrations;
Acts as the broader knowledge and resource person for regulatory frameworks and processes;
Encourages and supports knowledge sharing, exchanges of experience and partnership building.
Provide guidance to relevant higher government level institutions in the process of improving their operational frameworks, enabling more effective policy delivery:

Contributes to design and delivery of limited advice in annual prioritisation and budgeting by higher government level institutions;
In direct interaction with the Local Government, the Economic Development and the Environment and Water Management Officers, assists partner cantonal / entity institutions to design, manage and evaluate the impact of public financial grant schemes supporting LGs;
Steers, designs and quality assures the delivery of technical assistance to relevant higher government level institutions to strengthen their policy, operational and institutional frameworks;
In direct interaction with the Environment and Water Management Specialist, supports participatory definition and eventual setting up of the Water Tariff Regulatory Bodies;
Prepares analytical reviews and systematically captures lessons learnt and development effects from the viewpoint of relevant policy, legal and regulatory frameworks and processes.
Pro-actively support partnerships, networking and advocacy in the Project implementation, as well as in the broader UNDP local governance programme:

Captures and ensures wide promotion and visibility of Project achievements, particularly with regard to regulatory amendments and new legal acts;
Ensures regular communication and coordination with Project counterparts and develops and maintains effective mechanisms for integrating and responding to their feedback and insights;
Encourages active participation of all stakeholders in order to promote empowerment and ownership of all interested stakeholders;
Contributes to knowledge sharing among the wider UNDP local governance team.

Supports mainstreaming gender equality in Project implementation;
Ensures that relevant regulatory / policy documents are written using gender sensitive perspective and language.

Required Skills and Experience
Education:

Advanced university degree in legal studies.
BA degree in legal studies with additional two years of working experience may be accepted in lieu of the advanced university degree.
Experience:

At least three years of relevant working experience in the areas of legal / regulatory frameworks design or amendment; knowledge of and previous experience in the local governance regulatory framework in Bosnia and Herzegovina is a distinct asset;
Previous experience in providing support to capacity development and legal advice to public administration bodies at higher or local government levels;
Understanding of the overall political, administrative and institutional set-up of Bosnia and Herzegovina.
Language Requirements:

Fluency in English and in official languages of Bosnia and Herzegovina.
