In 2015, UNDP launched the implementation of the Strengthening the Role of Local Communities/Mjesne zajednice in Bosnia and Herzegovina Project, which is financed jointly by the Government of Switzerland and the Government of Sweden. The project goal is to improve quality of life of the citizens of Bosnia and Herzegovina (B&H) through improving local infrastructure and services, increasing democratic accountability and social inclusion. The chosen means to achieve this goal is through encouraging community-led local development and revitalising of mjesne zajednice (MZs) as the places where government comes closest to the people and as grass-roots organisations that serve communities, with the possibility for real participation and joint action.
The Project’s implementing strategy is to support and drive forward change from bottom-up by engaging citizens and communities and giving them a voice in local governance processes, and by revitalising MZs as spaces where citizens come together to interact and involve, to identify and solve problems, to transmit their concerns to the local government and participate in the ways it makes its plans, spends their money and takes decisions that affect people’s lives. In doing so, the Project places MZs and their communities at the centre of its work, while also relying on a broad range of relevant stakeholders to sustain and expand Project results and increase democratic accountability. The Project works with 24 LGs and 136 MZs country-wide. The key Project stakeholders are the following LGs: Banja Luka, Bijeljina, Brcko distrikt, Gracanica, Gradacac, Gradiška, Ilijaš, Jablanica, Kljuc, Kotor Varoš, Laktaši, Ljubinje, Ljubuški, Nevesinje, Olovo, Pale FBiH, Petrovo, Rudo, Sanski Most, Stari Grad Sarajevo, Tešanj, Visoko, Zenica, Žepce, as well as their respective local communities that are part of the project.

Focus of this Terms of Reference is on the Project Outcome 3, which is related to providing support to the governments in B&H in development of a new regulatory framework for functional MZs that enables more inclusive, gender-sensitive and accountable local governance in BiH. Goal is for the project to support creation of a legal basis for a more effective functioning of all the MZs in the country. In that light, the project has developed comprehensive studies on new vision of the MZs and legal analysis of the MZ status in BiH, which supports the aim of the third outcome which is to create a new legal structure that fits with the vision across all tiers of the government in B&H, and to create an environment where MZs can become effective and democratic channels for citizens to participate in their own governance.

In addition, the project will coordinate activities with Associations of Cities and Municipalities of FBiH and RS, as well as with all of the line ministries responsible for local self-governance, including as the FBiH Ministry of Justice and the RS Ministry of Administration and Local Self-Governance, as well as relevant administrative units in Brcko District of BiH.

Purpose of the Consultancy

The purpose of this Terms of Reference is to define the role of the Team Leader of the “Team for realisation of the Status of MZs in Republika Srpska (RS) legislation” in crucial project activities corresponding to new regulatory framework for functional MZs developed by governments enabling more inclusive, gender-sensitive and accountable local governance in Bosnia and Herzegovina.

Objective of the Consultancy

To lead the consultative process of drafting concrete recommendations to the government of Republika Srpska (RS) for changes and amendments of existing legislature, as well as work on new legislation according to adopted MZ vision model, including consultations for the new MZ-related regulatory and policy frameworks in Republika Srpska.

The Leader will lead the process and support the Team in further contextualizing of MZs in order to determine institutional and legal requirements between the MZs and the LGs based on the developed analysis of legal framework of MZs in B&H.

Duties and Responsibilities
For the purpose of implementation of the Outcome 3 (Enabling regulatory framework for community government), the Project will closely collaborate with the selected Team Leader. The Leader will be responsible for the implementation of activities described within this Terms of References and the Terms of References for the Team.
The Leader will perform coordination and management function directly contributing to institutionalization of the MZ project objectives. The Team Leader, as a lead individual, will have a key role, particularly in initiating the activities of the Team, as well as dialogue between members of the Team towards achievement of the set goals.

More specifically, the Leader will undertake following tasks:

· Provide leadership and governance of the Team so as to create the conditions for overall Team effectiveness;

· Initiate the Team meetings and set meeting schedule and agenda;

· Lead the process of drafting and adoption of the working plan of the Team for further activities;

· Harmonize and summarise in written the views and suggestions of the Team members regarding legal analysis, with the focus on Republika Srpska (RS);

· Lead the process of drafting of the document which will provide the Team’s recommendations to the government of Republika Srpska (RS) for changes and amendments of existing legislature, as well as work on new legislation according to adopted MZ vision model if needed, including any legal, by-law and implementing regulations, by providing practical examples and suggestions of the legal and/or the by-law acts needed for amending existing legislation in RS with a focus on local communities (MZs).

· Initiate and lead the advocacy process for implementation of the Team’s recommendations to the government of Republika Srpska (RS) for changes and amendments of existing legislature, as well as work on new legislation according to adopted MZ vision model.

· Initiate and organize at least 3 working meetings of the Team members by the end of the calendar year 2018, making sure the quality work on the tasks of the Team as described above;

· Participate in roundtables/workshops/meetings with members of other Entity Commissions/Teams and Brcko Districts of BiH and appoint designated lecturers.

Consultation with local partners and key stakeholders

Participatory consultation and validation processes will include all decision-makers and key stakeholders from partner institutions. Final consultation on developed and disseminated legal and institutional drafts, as well as advocacy for formal adoption will be carried out according to the applicable procedures of UNDP and the Republika Srpska government.

Overall, potential MZ-related regulatory amendments at entity/LG level will positively influence the broader local governance, particularly with regard to downward accountability of LGs to their citizens and increased public trust in LGs; pro-active citizen participation in public affairs, fair political representation, participatory definition of development priorities and efficient service delivery.

Deliverables/outputs:

· Draft an action plan of the Team activities -1 April 2018, 5%;

· Present the action plan of the Teams at Joint panel discussion at the BiH level – 1 May 2018, 5%;

· Harmonize and summarise in written the views and suggestions of the members of the Team regarding legal analysis, with the focus on RS – 5 June 2018, 20%;

· Draft the document which will provide the Team’s recommendations to the government of Republika Srpska (RS) for changes and amendments of existing legislature, as well as work on new legislation according to adopted MZ vision model if needed, with short-term and long-term recommendations – 10 September 2018, 40%;

· Develop plan and conduct the advocacy activities for implementation of the jointly agreed Team’s recommendations with the Government and other relevant stakeholders in the RS – 5 October 2018 – November 2018, 20%;

· Represent the Team at meetings with members of other Entity Commissions/Teams and Brcko District of BiH. Present the activities, plans, and achievements of the Team – 2 December 2018, 10%;

Competencies

· Extensive knowledge and experience in BiH legislative framework, including all levels of governance;

· Extensive experience and work in relation to BiH institutional governance, with an accent to systems across all levels of BiH governance;

· Extensive knowledge of the BiH political system with the focus on Republika Srpska, accompanied with socio-economic affairs;

Required Skills and Experience
Academic Qualifications/Education:
· PhD in Law;

· A master’s degree and at least 15 years of relevant experience would also be acceptable.

Experience:

· At least 15 years of relevant professional experience related to legislative drafting, preparation of legal analysis, legal opinions and institutional assessments, preferably in the area related to Local Governance.

Languages Requirements:

· Fluency in languages of Bosnia and Herzegovina (excellent writing, editing and communication skills).

· Fluency in English is an asset.

Other Requirements:

· Strong analytical, reporting and writing abilities;

· Excellent organizational, time management and facilitation skills;

· Excellent public presentation and moderation skills.

EVALUATION

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

· * Technical Criteria weight-70%

· * Financial Criteria weight- 30%
