The purpose of this consultancy is to support the performance of thorough assessments of the performance management systems in selected localities in Bosnia and Herzegovina.
Objective
This objective of this consultancy is to provide analytical support to the MEG Project Team in developing adequate assessment methodology, conducting the assessments and identifying gaps and concrete recommendations for further strengthening of the performance management systems of 6 local governments (LGs), namely: Bihac, Bosanska Krupa, Cazin, Kostajnica, Sanski Most and Velika Kladuša (LOT 1). For that purpose, a National Consultant (hereafter – the Consultant) will be recruited.

Background Information
The Municipal Environmental and Economic Governance Project is a newly-launched intervention in the domain of local governance in Bosnia and Herzegovina. It is financed by the Government of Switzerland, and implemented by the United Nations Development Programme (UNDP) during its first phase (2016-2020) in partnership with the Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina, the Ministry of Development, Entrepreneurship and Crafts of the Federation of Bosnia and Herzegovina (FBiH), the FBiH Ministry of Agriculture, Water Management and Forestry, the Ministry for Administration and Local Self-Government of Republika Srpska (RS), the RS Ministry of Agriculture, Forestry and Water Management and both entity Associations of Municipalities and Cities.
The Project’s overall goal is defined as follows: Municipalities, assigned with appropriate competences and finances, have improved their democratic governance and provide public services in an inclusive, effective and efficient manner, particularly those related to economic and environmental sectors.
Against this overall goal, three broad lines of action are envisaged:

· Democratic public policy and sound management processes within local governments (LGs);

· Provision of high quality public services within the economic and environmental sectors that are responsive to citizens’ needs;

· Regulatory frameworks at higher government levels enable effective public service delivery.

The Project’s territorial focus is on the North-West part of the country (including Una-Sana Canton and Prijedor region) and the North-East region (the wider Doboj-Tuzla area), covering 18 partner local governments: Bihac, Bosanska Krupa, Cazin, Doboj, Gracanica, Gradacac, Gradiška, Kalesija, Kostajnica, Kozarska Dubica, Prijedor, Prnjavor, Sanski Most, Tešanj, Teslic, Tuzla, Velika Kladuša and Žepce.
This consultancy will take place within the Project’s governance component, which will seek to check the feasibility and introduce a systemic and comprehensive performance management system for local governments in the country.
Performance management is critical to ensure that development strategies are being implemented, that they have the desired developmental impact, that decisions are taken and resources – being used efficiently and transparently, resulting in citizen-centred municipal performance. Performance management is a critical companion of integrated development planning: local development strategies set out what local governments intend to do and performance management systems ensure that they do. Therefore, the Project will build on the achievements of the Integrated Local Development Project (ILDP), further advancing integrated planning and development management into a wider municipal performance management system, with specific focus on the environmental and economic sectors.

Duties and Responsibilities Scope of work
Within this Consultancy, a thorough assessment of the existence and the level of maturity of the performance management system will be conducted for selected 6 target local governments. The assessment will look at the institutional, political (decision-making) and regulatory aspects of the local government performance management system, analysing accountability, transparency, effectiveness and efficiency of local governments.
In fine-tuning and finalising the assessment methodology and scope, the Consultant will take into consideration the general conceptual inputs from the MEG Project Team, as well as the results from the ILDP related to setting in place basic development management system in selected localities.
The assessment will capture key situation findings and analytical reflections along several main areas and specific aspects within these areas. In general terms, the key performance areas to be looked at by the assessment shall include (but may not be limited to):
Leadership, representation, decision-making and oversight by Municipal Councils
· Legislative efficiency;

· Timely adoption of the budget;

· Availability and actual application of oversight, checks and balances rules and procedures;

· General capacity, operational framework and effectiveness of municipal councils, including interaction with the administration and citizens;

· Political stability;

· Women councillors;

· Social inclusion and representation of the most vulnerable communities.

Transparency and accountability

· Mechanisms, procedures and tools to inform citizens;

· Availability of updated public information on municipal websites;

· Availability of mechanisms for public monitoring of local governments’ performance;

· Transparency of the local government budget;

· Availability of complaints mechanisms for the citizens;

· Availability and application of anti-corruption plans and measures.

Participation

· Public participation mechanisms and structures;

· Availability and documented effective use of frameworks and procedures to engage and consult citizens on public affairs or seek feedback from them.

Effectiveness and efficiency

· Existence of strategic planning frameworks and documents (development strategy);

· Existence and capacity of a local development management function, which drives overall coordination of strategies’ implementation, facilitates cross-departmental interaction and monitors short-term and long-term development results;

· Existence of short-term (annual) and participatory operational planning based on the local strategies and directly linked with local governments’ budgets;

· Structure of the local administration, staffing and review of the number of municipal employees per capita of the municipal population; capacity of the administration, with particular focus on the economic and environmental departments/structures;

· Existence and quality of cross-departmental coordination in planning, implementation, monitoring and reporting of policy delivery and development results;

· Existence of mechanisms and practices related to monitoring annual progress based on set performance benchmarks and capturing result-based achievements, which are shared with the citizens;

· Existence and quality of human resource management system, including annual human resources training plan;

· Extent to which the local government applies objective and result-oriented performance management of municipal employees (setting professional targets, mid-year review, annual performance review) and extent to which this is directly linked with annual departmental/municipal plans;

· Existence and quality of departmental plans linked with short-term municipal plans, so all envisaged public service/development management priorities have their concrete “implementation address” and responsible units/employee;

· % of expenditure on wages of the local government operating budget;

· % of local government’s operating budget vs capital investments;

· Breakdown of local government’s debt (loans, liabilities, dues) with maturity dates;

· Technical capacity (internet, equipment);

· Existence of policy and service delivery monitoring and evaluation practices and frameworks.

· The assessment will be conducted based on a combination of the following tools: questionnaires, structured interviews with relevant local government leaderships/employees; focus group discussions; desk review of the existing regulatory framework and municipal formal documentation; review of public information sources (websites, on-line portals for interaction with the citizens, etc.). In all cases, the assessment for each local government against the main areas of review will be as objective as possible, based on participatory inputs by relevant stakeholders, as well as substantiated by evidence and facts to the maximum extent possible. Subjective information and inputs gathered from various stakeholders through interviews can also be utilized to form an assessment opinion. In addition, from the Project viewpoint, the findings and conclusions provided within each of the Assessment Reports will also serve as benchmarks for measuring future progress in respective areas.

The Consultant is expected to prepare analytical report for each of the 6 target local governments. The main findings, conclusions and recommendations will be presented to the MEG Project Team and subsequently – to the local governments. The results of the analysis are expected to offer a clear insight into the areas that needed attention, which would subsequently entice follow-up tailored assistance by the MEG Project to improve local governments’ performance management systems.
Specifically, the Consultant will have the following tasks:
Task 1: Fine-tuning and finalizing the assessment methodology and work plan
While the general approach to the assignment and proposed methodology will be submitted by interested Consultants as part of their applications, at the beginning of the process the selected Consultant will fine-tune and finalise the proposed methodology for the assessment% of a. In that process, the Consultant will work in direct interaction with two other Consultants selected for parallel assessment of other local governments. Ultimately, the MEG Project Team will seek to apply a harmonized and coherent assessment methodology across all target localities. All relevant materials which can be considered in the assessment (such as reports from other projects, etc.) will be provided to the Consultant by UNDP.
Therefore, based on specific inputs and guidance by the MEG Project Team, and in direct interaction with the other two Consultants, the Consultant will be expected to submit a comprehensive methodology for conducting the assessment, including: i) description of the approach and tools to be utilized; ii) main target groups; iii) detailed development of questionnaires, as needed; iv) preliminary structure of the Assessment Report and v) detailed work plan. The final methodology will be endorsed by the MEG Project.
It is envisaged that this task will be delivered by early September 2016 and the level of effort will not exceed 2 expert days.

Task 2: Conduct review and analysis of relevant institutional, administrative and legal frameworks related to the overall performance management systems in 6 local governments
After agreeing on the methodology, the Consultant will initiate the actual analysis. To that end, the Consultant is expected to follow the proposed approaches and time dynamics as proposed within the methodology and take stock, collect information and conduct assessment review and interviews/focus group discussions with relevant stakeholders within the 6 selected localities.
All this information will serve as the foundation for drafting the Assessment Reports (including key findings, analytical reflections and customised recommendations for each area).
It is envisaged that this task will be delivered by mid-October 2016 and the level of effort will not exceed 24 expert days (4 expert days per locality).

Task 3: Develop Performance Management Assessment Reports for all 6 local governments
The assessment, reviews and data collected through interviews or discussions with relevant municipal stakeholders will then be captured in Performance Management Assessment Reports for each target local governments, following the report structure agreed under Task 1 of these ToR.
In general, each Assessment Report will comprise analytical review of the current situation for each of the aspects related to the local governments’ leaderships and oversight, transparency, participation, effectiveness and efficiency, as presented captured previously in these ToR. For each of these areas, the Consultant will provide narrative analytical description of the current situation and practices (supported by reference evidence, facts, numbers, inputs by interviewees, etc.); highlight main gaps and deficiencies, as well as offer concrete recommendations for the way forward. The areas can be expanded as per the Consultant’s view. The indicative length of the Assessment Report is up to 25 pages (without annexes).
Given that this effort aims at changes within local administrations (including internal re-organisation, new internal procedures, functions, structures and tools, etc.) it is of key importance that the findings and recommendations are presented to and accepted by local governments’ leadership. Therefore, all draft Assessment Reports will be reviewed and approved by the MEG Project and subsequently presented to municipal leaderships (most probably after the October 2016 Local Elections) in the 6 target localities.
It is envisaged that this task will be delivered by the early November 2016 and the level of effort will not exceed 18 expert days (3 expert days per Assessment Report).

Deliverables and timelines
The consultant is responsible for the following deliverables:

· Task 3: Develop Performance Management Assessment Reports for all 6 local governments

Written assessment reports on the situation with regard to the municipal performance management system in selected 6 local governments as per the approved methodology and areas of work described in these ToR are approved by the MEG Project and presented to the respective municipal leaderships. November 2016, (18 expert days)

Required Skills and Experience
Education:
· University degree in public administration, economics, law, political sciences or related field. Advanced degree will be an asset.

Experience:

· At least 5 years of relevant experience in the field of public administration reform, organisational strengthening and human resource management, particularly at local government level;

· Previous experience, practical work and delivery of technical and training assistance to local governments in the areas of performance/organisational management and overall capacity development is required;

· Experience in public policy research is required;

· Practical experience in conducting similar assessments at the local government level in Bosnia and Herzegovina is considered a distinct asset;

· Excellent communication and facilitation skills;

· Excellent knowledge of the broader local governance policy and regulatory frameworks in Bosnia and Herzegovina;

· Proven analytical skills and ability to conceptualize and write concisely and clearly.

Language Requirements:

· Fluency in all official languages of Bosnia and Herzegovina, and in English.
