The purpose of this assignment is to support the Human Rights Ombudsman Office in Bosnia and Herzegovina (BiH) in development of the Special Report on human rights issues faced by LGBTI persons and to support the Office in adjudication of the human rights cases filed to the Ombudsman Office.
The incumbent will provide legal services to the Ombudsman Office and will conduct desk research, interviews and focus groups discussions with civil society, LGBTI advocates and government institutions. S/he will assist the Ombudsman in reviewing the past and present human rights cases with a special focus on discrimination of LGBTI persons capturing best practices in adjudication of these cases.
Objective
The overall objective of this assignment is to increase capacities of the Ombudsman Office in identifying key human rights issues linked to the status of the LGBTI population and to expeditiously adjudicate human rights cases relevant to this topic.

To achieve this objective, the incumbent will be responsible to conduct a nation-wide assessment on the status of the human rights of the LGBTI population based on the extensive consultations with project partners. S/he will be assisting the Ombudsman Office to decrease the backlog of the human rights cases and to capacitated the Office with the new experiences and knowledge that would help them in their future work on LGBTI-related human rights issues.
Background Information
United Nations Development Programme (UNDP) in Bosnia and Herzegovina (BiH) is providing assistance to the Ombudsman Office in BiH in development of the special report on human rights issues faced by LGBTI persons. The assistance will furthermore expand on capacity building and case management of the Ombudsman Office in BiH.

The project will be financially supported by USAID and builds on the USAID LGBTI Global Development Partnership in support of LGBTI human rights and equality around the world.
The overall project objective is to strengthen the capacities of the Human Rights Ombudsman of Bosnia and Herzegovina in promotion and enforcement of human rights. In particular, the intervention will focus on strengthening capacities of the institution of the Ombudsman office to deliver a Special Report of the on access to rights by lesbian, gay, bisexual, transgender and intersex (LGBTI) persons. The report, first of this kind, will not only identify and assess the root systemic and legislative flaws contributing to and perpetuating the human rights violations against the LGBTI but also chart the roadmap for mitigating the identified gaps and raise awareness of the key stakeholders and general public to prevent recurrence of human right breaches against this population.

Despite an increase in violence, attacks and threats towards LGBTI persons and human rights defenders, only a limited number of cases are reported to the authorities. Effective protection of human rights in BiH is undermined by procedural hurdles and the uneven implementation of the anti-discrimination legislation, and the LGBTI community continues to be subject to human rights violations.

The United Nations Development Assistance Framework for BiH, as well as the UNDP Country Programme Document (2015-2019) firmly commits to developing new skills and services to strengthen implementation of legal and human rights mechanisms and frameworks according to international standards. UNDP Country Programme Document for BiH (2015-2019) identifies LGBTI persons among the most socially excluded and vulnerable groups and commits to provide technical assistance to relevant institutions to support the human rights agenda the employment opportunities and access to services.

In this light, strengthening the Ombudsman Office to promote and enforce human rights is of paramount importance – particularly since with the adoption of the Anti-Discrimination Law the Ombudsman is designated as “the central institution authorized for protection from discrimination”. The Ombudsman Office has special powers and jurisdiction under the anti-discrimination law, and within its jurisdiction monitors legislation, but also receives complaints on discrimination, instructs persons about their rights, options for judicial and other protections, collects and analyses statistical data, and submits annual reports on discrimination.

Duties and Responsibilities The scope of work includes preparation of the Special Report on the human rights issues related to the LGBTI population. The report drafting will be based on the extensive consultative process with the stakeholders throughout the country. The implementation modality will be designed on the basis of the in-office drafting process and round table discussions with the partner institutions. The findings of the Report will be widely promoted with key stakeholders. In addition, the incumbent will be supporting the Ombudsman Office in reviewing the cases related to the LGBTI human rights issues as well as other cases as delegated by the Ombudsman. S/he will be responsible to maintain a back-log of best practices in adjudication of the human rights cases and to develop an action plan for its future incorporation in the Ombudsman Office practices.
Deliverables and timelines
The consultant is responsible for the following deliverables:

Required Skills and Experience
Education:
· University degree in Law obtained in Bosnia and Herzegovina (BiH); or an university degree in law obtained in former SFRJ before 06 April 1992; or a four-year university degree in law in Bosnia and Herzegovina with 240 ECTS; or an equivalent international degree recognized in Bosnia and Herzegovina under the same terms and conditions as a BiH degree as stipulated above;
Experience:
· Minimum 1 year of relevant professional experience;
· Sound knowledge of domestic and international human rights instruments, norms and standards;
· Experience in conducting written assessment and critical analysis will be considered as a strong asset;
· Previous experience working with vulnerable groups will be considered as a strong asset.

Language Requirements:
· Knowledge in written and spoken English and Bosnia/Serbian/Croatian languages.
