In response to the reports and efforts of the Special Representative of the United Nations Secretary General on Violence in Conflict and the UN Special Rapporteur on Violence against Women, the UN developed a Joint Programme entitled “Seeking care, support and justice for survivors of conflict related sexual violence in Bosnia and Herzegovina (BiH)”. The reports recognized the critical need to provide assistance and services to survivors of conflict related sexual violence (CRSV), declaring BiH one of the UN’s focal countries, placing it squarely in the world’s spotlight, and highlighting the need for a comprehensive approach to tackling CRSV.
The reports highlighted the lack of widespread societal recognition of the harms suffered by women during the war, the stigma and attitudes of society towards victims of sexual violence, and the denial of their existence. The reports further emphasized the need for services, such as free legal advice to help survivors navigate the complex legal framework in the entities and apply for welfare or other benefits, and access to affordable and appropriate health and mental care services, including sexual and reproductive health services.
The Joint UN Programme is aimed at promoting the rights and respond to the needs of survivors of conflict-related sexual violence from the conflict in Bosnia and Herzegovina in the early 90s, and at providing redress to both them and their families. In particular, the Programme works on improving the status of CRSV survivors and their access to justice, reparations, health and social protection services in their respective communities. It represents the combined efforts of IOM, UNDP, UNFPA and UN Women (hereafter: ‘participating UN organizations’), and demonstrates the resolve of the entire UN Country Team (UNCT) to tackle this issue.
Purpose

UNDP is looking to contribute to enhancing the support and response to GBV and CRSV survivors by developing a Training of Trainer package for selected justice service providers – Free legal Aid providers in Bosnia and Herzegovina (FLA providers) in strengthening their response to all forms of gender-based violence, including conflict related sexual violence in Bosnia and Herzegovina. The process will be implemented in close partnership with responsible State/entity/BD levels governmental institutions through a working group. It envisions assessing existing guidelines and referral protocols in justice sector and their revision to meet the international standards including the Global Services Guidelines developed globally by UNDP/UNFPA/UN Women and UNFPA Essential Services Package for systemic pillars.
In addition, this assignment includes engagement of two consultants each responsible for specific areas of work as identified in respective terms of references. One consultant (lead consultant) will be responsible for developing training packages for trainers (ToT) and the other one will be responsible for developing an Adult Learning Module (ALM) within the ToT packages. However, they should work as a team and jointly consolidate the ToT packages. The lead consultant will be responsible for submitting the complete ToT packages including the adult learning module. The work requires consultation and coordination of activities among the two consultants on a daily basis.

Objective

Under the supervision and day-to-day coordination with UNDP Legal Expert, the consultant is expected to develop training packages for trainers and professional staff within FLA agencies based on respective resource packages for FLA providers (BIH/Brcko District level, FBiH, RS respective ministries of justice) in strengthening their response to all forms of gender-based violence, including conflict related sexual violence in Bosnia and Herzegovina. The process will be conducted in cooperation with the members of a Working Group established by the Ministry of Justice of BIH which is inclusive of relevant ministries of justice at the state, entity and Brcko District level and selected FLA representatives.

Duties and Responsibilities
The process will include stages outlined below.
The Lead Consultant is responsible for the completion of the overall document and must ensure the following delivery:

Desk research

· Review of existing materials, namely minimum standards, guidelines and referral protocols for the FLA providers’ response to GBV and CRSV (resource packages for FLA providers). In close cooperation with UNDP, the consultant is expected to review Global Service Guidelines and Essential Services Package, minimum standards for service provision to CRSV survivors and other relevant domestic and international documents to identify gaps in domestic guidelines and referral protocols and suggest areas for harmonization with international standards (guidelines, referral protocols).

Development of detailed methodology for the process of developing deliverables

· Develop methodology to be used in the process. Methodology should include:

· List and review of international and domestic standards for justice sector response – FLA providers’ to GBV and CRSV to be used in the process with the indication of the areas for the harmonization of domestic with international standards. One of the consultant’s main guiding document will be the Essential Services Package, Global Services Guidelines and UNDP and UNFPA BIH Packages;

· Detailed structure of a working group meeting including the timeframe for implementation of the activity and draft agenda for the meeting;

· Structure of the final product – three ToT packages for FLA providers (one for each entity – i.e. FBIH and RS and one for the BIH level and Brcko District) including the ALM as an essential part of the ToT. At this stage, the structure should at minimum indicate the subsections/chapters of the ToT packages;

· Special focus on the adult learning elements, as an essential part of the ToT packages (on top of the thematic, substantive inputs relating to justice elements) – adult learning must be tackled through a dedicated module within the training packages;

· Validation of the methodology. Proposed methodology needs to be presented to and validated by UNDP staff.

Development of ToT packages for FLA providers’ response to GBV and CRSV in Bosnia and Herzegovina

· Development and submission of the final product – three ToT packages for the FLA providers’ response to GBV/CRSV in BIH BIH including the Adult Learning Module, as an essential part of the ToT packages;

· They document should contain the following sections: introduction, methodology, international standards, training sessions, adult learning modules and monitoring and evaluation of training package. Each package should be minimum 30 and maximum 50 pages long;

· Preparation and facilitation of a working group meeting – Prepare the structure of the meeting for validation of the ToT, develop materials to be used in the validation session, develop a list of participants, agenda;

· Validation – Training of Trainers packages will be validated by UNDP, members of the working group and the FLA Network. In addition, FLA network meeting will be organized to present and validate ToT Packages to the FLA providers;

The consultant is expected to present the ToT Packages at this meeting.

Deliverables and timelines

The consultant is responsible for the following deliverables:

· Submission and presentation of Detailed Methodology for the process of developing deliverables to UNDP staff in BHS languages; detailed structure of the working group/FLA meetings with preparation of substantive inputs and facilitation of one WG meeting; August 18 – 10%;

· Submission of a draft product – ToT Packages for the FLA providers’ response to GBV/CRSV in BIH to UNDP review and comments in BHS languages; August 25 – 40%;

· Submission of the final product – ToT Packages for the FLA providers’ response to GBV/CRSV in BIH to UNDP in BHS languages; September 11 – 45%;

· Participation and presentation of the ToT Packages for the FLA providers to the Working Group members and FLA providers at a FLA Network meeting for its final validation in BHS languages; Submission of report from the FLA meeting; Mid-October – 5%;

Education:

Experience:

· At least 10 years of relevant professional experience in the field of Law and human rights; relevant professional experience in developing training manuals, modules and resource packages with a focus on GBV/CRSV victims for the justice/health sector service providers;

· Extensive knowledge and proven experience in working with justice sector on human rights protection of vulnerable groups focused, among others, on GBV and CRSV victims; experience in research, service development, assessments, monitoring and evaluation;

· Experience in development of legal oriented expert publications, analysis, guidelines.

Language requirements:

· Proficiency in official languages of Bosnia and Herzegovina.

EVALUATION

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis
When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

· * Technical Criteria weight-70%

· * Financial Criteria weight- 30%
